
This paper explores the growing data privacy concerns surrounding in-vitro fertilization (IVF) clinics and the evolving responsibilities these clinics face in managing sensitive patient information. It aims to understand how privacy practices within IVF facilities operate under their existing regulatory framework particularly the Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021 and how these intersect with India’s newly introduced Digital Personal Data Protection Act, 2023 (DPDPA). By examining this overlap, the study highlights the complex interplay between medical ethics, legal compliance, and the digital transformation of healthcare in India.
